Family & Medical Leave Act (FMLA) Information

At Bajaj Plastic Surgery, we understand that undergoing surgery or medical procedures can impact both your personal and professional life. To assist you, we provide detailed information about the Family and Medical Leave Act (FMLA) and how it may relate to your situation.

What is FMLA?

The Family and Medical Leave Act (FMLA) is a federal law that allows eligible employees to take unpaid, job-protected leave for specific medical and family reasons. This includes time off for recovery from surgery or to care for a family member who is receiving treatment.

How FMLA May Apply to You

  1. Recovery from Surgery: If you are having a procedure at Bajaj Plastic Surgery and need time off to recover, you may be eligible for FMLA leave if your employer meets the FMLA criteria.
  2. Family Care: If you need to take time off to care for a family member undergoing treatment, you might qualify for FMLA leave if your employer is covered by the FMLA.

FMLA and Cosmetic Procedures

Please note that FMLA generally does not apply to elective cosmetic procedures, as these are typically not covered under FMLA provisions. FMLA is more commonly applicable to medically necessary procedures and conditions. We recommend checking with your employer or HR department to confirm if any leave options are available for elective procedures.

Eligibility for FMLA

To qualify for FMLA leave, you generally need to meet the following criteria:

  1. Employment Duration: You must have been employed with your employer for at least 12 months.
  2. Hours Worked: You must have worked at least 1,250 hours in the 12 months preceding the leave.
  3. Employer Coverage: Your employer must have at least 50 employees within a 75-mile radius to be covered by FMLA.

Requesting FMLA Leave

To request FMLA leave related to your surgery or to care for a loved one:

  1. Contact Your Employer: Speak with your employer’s HR department or FMLA coordinator to discuss your leave options.
  2. Obtain Documentation: Contact Bajaj Plastic Surgery to request the necessary documentation. There is a $50 fee for completing FMLA paperwork. Payments can be made in person or over the phone.
